Senator McCaskill Concerned About Reverse Mortgage Fraud

imageSenator Claire McCaskill voiced her concerns over issues related to reverse mortgages at a Senate Proceeding last week.  She estimates that there will be 200,000 new reverse mortgages this year and believes it has the potential to become a huge liability to the American taxpayer if more guidelines aren’t put in place. 

One area she is worried about is the way lenders are marketing reverse mortgages.  “You turn on any cable channel almost in America and before midnight you’re going to see an ad that says to seniors, you need to take advantage of a great government program, a government benefit,” said McCaskill.

This is a concern that many of us in the industry share and is something that I see as the next big blow up we are facing unless some type of guidelines are issued.  Last year, a company in Massachusetts was issued a cease and desist due to unfair and deceptive advertising practices and there has been other investigations too.  

During her speech, she adds that HUD’s inspector general has been investigating reverse mortgage fraud and has seen inflated appraisals, shoddy repairs being done, as well as people continuing to receive payments even after the senior has passed away or moved out.  She asks why is this kind of fraud increasing? 

According to her testimony, she believes that all the “bad actors” who were involved in the subprime meltdown are coming over the business and are the reasons we’re seeing an increase in fraud.

To help prevent this from continuing, McCaskill has filed an amendment to the legislation that is in front of the Senate to help with fraud prevention, detection, and enforcement provisions related to reverse mortgages.  She wants to require the borrower to report the termination of the residence to HUD and require that if a borrower uses a HECM for purchase that the property is owned and occupied for at least 180 days to prevent property flipping. 

Overall, I think there are some good ideas here, but I hope she takes her time to think these through before she goes on another crusade which ends up hurting the industry more than it helps.  You can watch her video at the link below.

    I agree with The Critic on this particular issue. With the amount of political pull Sen. McCaskill has within the new administration, and an almost certainly filibuster-proof majority to back her ideas in the Senate, courting by Missouri originators and the NRMLA members on behalf of the seniors we serve could only be beneficial. We need Senator McCaskill looking to us as allies not as the enemy.

    NRMLA has a good relationship with Barney Frank. This has proved beneficial not only to NRMLA members but also to seniors who need our help.

    It is past time to reach out to Senator McCaskill. If she would consent, I would love to see her at one of the NRMLA conventions. My concern after reading some of the comments on RMD is how well she would be received.

    We need to court the Senator. Imagine the impact if she supported our concerns and we could work effectively together with her staff to resolve differences. I am sure Mr. Bell, Mrs. Scholz, Mr. Hicks, Mr. Johnson, and Mr. DeMarkey have been diligently working on this. I hope that originators in Missouri are reaching out to the Senator not just to rebuke her but hopefully to meet with her and discuss with her what can be done to make things better for seniors and our industry.

    If the good Senator had a family that desperately needed the help that only a Reverse Mortgage can provide then she might think differently. Before anyone writes a law or makes a speech they should work in the industry for awhile and get some experiance. Unfortunately the hoops we have to jump through now are too many and time consuming. We are not protecting seniors we are punishing them. It might be a novel idea to punish the fraud instigators instead of making more rules that punish everyone.

    McCaskill continues to make a name for herself - all at the expense of the people in this industry that are doing things right.

    Servicers subscribe to "death report" services that tell them monthly when the borrowers have passed away. So, I don't know where this untold fraud of unreported orrower's deaths are happening? McCaskill also doesn't realize that there are already HUD guidelines that speak to what happens when the borrower moves from the home and the loan documents instruct the borrower to notify their servicer.

    Get ready folks...the legislation flywheel has started spinning and it isn't going to stop for a while now.
